We do not guarantee that product descriptions are 100% accurate, complete, reliable, current, or error-free. If a product offered is not as described, your sole remedy is to return it in unused condition per our Returns & Refund Policy.

4.2 Inventory & Availability

All products are subject to availability. We reserve the right to:

• Cancel orders for out-of-stock items and issue a full refund

6.2 Order Cancellation by Customer

You may request cancellation within 2 hours of placing your order by emailing support@eoapparel.store. Once an order enters processing, it cannot be cancelled or modified.

6.3 Order Cancellation by Us

We may cancel orders due to:

• Product unavailability
• Pricing or description errors
• Suspected fraud or unauthorized payment
• Violation of these Terms
• Shipping restrictions to the provided address

In all cases of cancellation by us, you will receive a full refund to your original payment method within 5-7 business days.

14. Dispute Resolution & Arbitration

14.1 Informal Resolution

Before filing any formal legal claim, you agree to contact us at support@eoapparel.store to attempt to resolve the dispute informally. We will make good faith efforts to resolve any dispute within 30 days of receiving your written notice.

14.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of our Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

• The arbitrator's decision shall be final and binding on both parties
• Judgment on the award may be entered in any court of competent jurisdiction
• Each party shall bear its own costs, except that the prevailing party may recover reasonable attorneys' fees

14.3 Class Action Waiver

You agree that any proceedings, whether in arbitration or court, will be conducted only on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in class or collective proceedings against us.

14.4 Opt-Out

You may opt out of the arbitration agreement and class action waiver within 30 days of first accepting these Terms by sending written notice to EO APPAREL, INC. at 8288 Mercury Dr
Buena Park, CA 90620. If you opt out, disputes shall be resolved in the courts specified in Section 15.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Subject to the arbitration agreement in Section 14, any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Pico Rivera, Los Angeles County, California. You consent to the personal jurisdiction of such courts and waive any objection to venue.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Returns & Refund Policy, constitute the entire agreement between you and EO APPAREL, INC. regarding your use of our Services, superseding any prior agreements, communications, or proposals.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of EO APPAREL, INC..
